Any individual who posts copy written material is subject to legal liability.
Furthermore, that individual will be banned from the OGR Forum.
Seen a few members get banned along the way. One of several reasons I no longer support that forum.
It’s ok for dealers to show real photos for their pre-order engines but not the supporting members.

I can't speak for all of the dealers but those that I have dealt with with respect to prototype photos have made sure they had permission to use the picture in their advertising. Given the litigious nature of modern day communications I suspect any manufacturer who uses a prototype photo of any kind makes it a point to get permission for its use.

OGR got sued for copyright material a member posted. They in turn tried to get the poster involved. The lesson here is DON'T post someone else's material without written permission.

You can just as easily post the internet link to a picture without repercussions.

My issue is their zero tolorance policy. You screw up once and you are done. Come on mistakes happen. I had a friend who was booted off the forum for a copyright pic. There was a thread from way back in 2018 that someone brought up with a reply. A pic was there and he got banned. My friend had no Idea about the policy and could not remember that thread from so long ago. Many of us have told Alan he would have to ban use all as we all have done it over the course of the forums life. I'm not certainly going spend all day researching posts for a pic I posted five, six, ten years ago.

I agree, zero tolerance is tough but I'm sure the size of their operation is such that having to pay someone for a violation of copyright could easily wipe them out. As others have noted, they faced this situation once and it is obvious they have no intention of facing it again. It really comes down to one thing - regardless of the format of the picture - if you don't own the copyright then post a link. If there isn't a link then forget it.

That's one thing with YouTube. If its there, you have made it public.

YouTube allows the creators to prevent their videos from being embedded. It is a very simple toggle you can set for your videos. If it's not set, you can embed elsewhere, which I take as implied permission but maybe the laws say different.

To me that forum is to much like a dictatorship in a lot of way. If for some reason they don't like a thread for what ever reason it will get removed.
I was basically attacked by Barry for a engine I bought from him, that I was trying to sell. I didn't even remember who sold it to me. I made a comment that I repaired it as someone took the command system out and I replaced it. well all of a sudden any thing he said was removed to make me look bad. Had to defend Barry. They should of just removed it. Policy you can not write about a advertiser or friend. There was nothing wrong with my post until Barry jump all over me trying to sell it, and saying if I knew you where going to tell the whole story to try and sell it, I would not of sold it to you. It's called put foot in mouth and chew vigorously.
But they came to his rescue LOL. that is one reason I do not visit or support that forum anymore and haven't for a few years.

If it's not set, you can embed elsewhere, which I take as implied permission but maybe the laws say different. . . . and I think it's that very uncertainty that fuels a lot of the recurring copyright trauma. Unless one is well versed in IP law, it's a real crap shoot trying to determine exactly where the line is sometimes. Some content creators (or their minions) have taken advantage of that uncertainty by alleging infringement even if recognized exceptions (such as fair use) might actually prevail. As an old-school title underwriter once told me, "Never insure into a lawsuit -- even if you eventually win, the cost and hassle will make you regret it!" Appropriate caution can easy bleed into paranoia, though, but it's hard to definitively argue with the snake-bit . . .

I only post pictures I have taken, the best approach otherwise is Traindiesel's.

I wonder how many of us have re-materialized as zombie members to keep the numbers up? I see I’m still un-dead, and I did a quick search - you’re still there too! Dave

Firewood, it seems the forums, seem to keep members on there rosters even actual dead ones to keep the member count up for some reason, either they don't really have the time to go through it and removed said ones or what.

I was given a verbal word salad by Mr. Snarky, so I started posting links to real photos. Unfortunately, there are some who lack PC skills on there and have to be spoon-fed. They can’t figure out links or simple things on their own.
If you don’t re-new your (voluntary) yearly forum subscription, you are axed.
I tried to increase the scale traffic vs. gauge over many years but could never get past 10 modelers.
YouTube is not going to save them now either. Never anything of interest on that forum for me anyway.
